🚛Request for Exemption

FMCSA requests public comment on an application from Yarde Metals, Inc. (Yarde Metals, USDOT No. 299202) for an exemption from the requirement that all exterior lighting devices be steady burning. The exemption would allow Yarde Metals to use an amber brake-activated pulsating lamp on its commercial motor vehicles (CMVs) in addition to the steady-burning brake lamps required by the Federal Motor Carrier Safety Regulations (FMCSRs).

🚛FMCSA Grants Exemption for Casey's Pulsating Brake Light Technology

The Federal Motor Carrier Safety Administration (FMCSA) announces its decision to grant an application from Casey's Services Company, USDOT No. 162449, (Casey) for an exemption to allow it to operate commercial motor vehicles (CMVs) equipped with a module manufactured by Intellistop, Inc. (Intellistop). The Intellistop module is designed to pulse the required rear clearance, identification, and brake lamps from a lower-level lighting intensity to a higher-level lighting intensity 4 times in 2 seconds when the brakes are applied and then return the lights to a steady-burning state while the brakes remain engaged. The Agency has determined that granting the exemption to Casey would likely achieve a level of safety equivalent to, or greater than, the level of safety achieved by the regulation.

🚛Denial of Motor Vehicle Defect Petition

This notice sets forth the reasons for the denial of a petition submitted to NHTSA on July 3, 2024, by Eric Hein, Director of the Institute for Safer Trucking (petitioner), requesting that the agency commence an investigation of all van-type (also known as box) semi-trailers due to collisions with passenger vehicles and vulnerable road users (pedestrians, bicyclists, or motorcyclists) resulting in significant injuries or death due to a lack of effective side underride guards (SUGs). On August 26, 2024, NHTSA opened Defect Petition DP24- 004 to evaluate the petitioner's request. After consideration of the petition, NHTSA believes that the issues raised here are best addressed through its recent rulemaking and the ongoing actions under the Infrastructure Investment and Jobs Act (IIJA). Accordingly, the agency has denied the petition.

✈️Airworthiness Directive for Boeing 777 Aircraft Requires Compliance

The FAA is adopting a new airworthiness directive (AD) for certain The Boeing Company Model 777-200, -200LR, -300, -300ER, and 777F series airplanes. This AD was prompted by a report indicating that an airplane experienced a glideslope (G/S) beam anomaly during an instrument landing system (ILS) approach, which resulted in a higher- than-expected descent rate during the final segment of an ILS approach. The flightcrew might follow misleading flight director (F/D) guidance after disconnecting the autopilot, without reference to the other available information and flight deck indications. This AD requires installing new autopilot flight director computer (AFDC) operational program software (OPS) and doing a software configuration check. The FAA is issuing this AD to address the unsafe condition on these products.
