🦎Salamander Regulations and Their Economic Impact on Businesses

The U.S. Fish and Wildlife Service is affirming as final the 2016 interim rule that added all species of salamanders from 20 genera to the list of injurious amphibians. Under the injurious wildlife prohibitions of the Lacey Act, this final rule prohibits the importation into the United States and shipment between the continental United States, District of Columbia, Hawaii, Commonwealth of Puerto Rico, or any territory or possession of the United States of any live or dead specimen, including hybrids and parts, of those 20 genera of salamanders, except by permit for certain purposes or by Federal agencies solely for their own use. In addition to finalizing the listing of those 20 genera, we are publishing a new interim rule to add to the injurious amphibian list 16 genera that recent studies determined are also carriers of the fungus and to clarify some provisions from the final rule. This interim rule includes any live or dead specimen, hybrid, or parts of the 16 genera and opens a public comment period. We take these actions to protect U.S. ecosystems from the introduction, establishment, and spread of the lethal chytrid fungus Batrachochytrium salamandrivorans, which infects and is carried by salamanders, and which is not yet known to be found in the United States.

🚢New Seaway Regulations Impacting Maritime Compliance and Operations

The Great Lakes St. Lawrence Seaway Development Corporation (GLS) and the St. Lawrence Seaway Management Corporation (SLSMC) of Canada, under international agreement, jointly publish and presently administer the St. Lawrence Seaway Regulations and Rules (Practices and Procedures in Canada) in their respective jurisdictions. Under agreement with the SLSMC, the GLS is amending the joint regulations by updating the regulations and rules in various categories. These changes are to clarify existing requirements in the regulations.

🦋Proposed Listing of Bleached Sandhill Skipper as Endangered

We, the U.S. Fish and Wildlife Service (Service), propose to list the bleached sandhill skipper (Polites sabuleti sinemaculata), an insect subspecies from Humboldt County, Nevada, as an endangered species under the Endangered Species Act of 1973, as amended (Act). This determination also serves as our 12-month finding on a petition to list the bleached sandhill skipper. After a review of the best available scientific and commercial information, we find that listing the subspecies is warranted. Accordingly, we propose to list the bleached sandhill skipper as an endangered species under the Act. If we finalize this rule as proposed, the final rule would add this subspecies to the List of Endangered and Threatened Wildlife and extend the Act's protections to the subspecies. We find that a designation of critical habitat for the bleached sandhill skipper is not determinable at this time.

🚧PHMSA Extends Comment Period for Hazardous Materials Regulations

On October 28, 2024, PHMSA published a notice of proposed rulemaking (NPRM) titled "Hazardous Materials: Advancing Safety of Highway, Rail, and Vessel Transportation (HM-265)," proposing amendments to the Hazardous Materials Regulations (HMR) to adopt several modal-specific amendments that would enhance the safe transportation of hazardous materials in commerce by highway, rail, and vessel transportation. In response to a request for an extension of the comment period submitted by the Railway Supply Institute (RSI), PHMSA is extending the comment period for the HM-265 NPRM by an additional 90 days.

🚍Proposed Changes to Charter Service Regulations by FTA

The Federal Transit Administration (FTA) is proposing to amend regulations that govern the provision of charter service by recipients of Federal financial assistance. The proposed changes will remove the Federal Financial Assistance Programs listed in an appendix and the guidance in additional appendices and make non-substantive technical edits throughout to remove outdated citations and provide clarity.

📋FMCSA Notice on ELD Vendor Registration and Compliance Requirements

In accordance with the Paperwork Reduction Act of 1995, FMCSA announces its plan to submit the Information Collection Request (ICR) described below to the Office of Management and Budget (OMB) for its review and approval and invites public comment. FMCSA requests approval to renew an ICR titled, "Electronic Logging Device (ELD) Vendor Registration." This ICR is necessary for ELD vendors to register their ELDs with the Agency.

⚓Proposed Drawbridge Regulation Changes Impacting Business Traffic

The Coast Guard proposes to change the operating schedule that governs the Blackburn Point Bridge across the Gulf Intracoastal Waterway (GICW), mile 63.1, at Osprey, FL. The Casey Key Association has requested the Coast Guard consider changing the operating schedule to reduce drawbridge openings during the weekday peak traffic periods to assist with alleviating roadway congestion. We invite your comments on this proposed rulemaking.

✈️FAA Proposes Airspace Modification for Battle Mountain Airport

This action proposes to modify the Class E airspace area designated as surface area, establish a Class E airspace area designated as an extension to a Class D or Class E surface area, modify Class E airspace extending upward from 700 feet above the surface of the earth, and remove Class E airspace extending upward from 1,200 feet above the surface at Battle Mountain Airport, Battle Mountain, NV. Additionally, this action proposes administrative amendments to update the airport's existing Class E airspace legal descriptions. These actions would support the safety and management of instrument flight rules (IFR) operations at the airport.
