🌍EPA Denies Petition Against Shell Chemical's Operating Permit

The Environmental Protection Agency (EPA) Administrator signed an Order dated December 19, 2024, denying a petition dated June 11, 2024, from Air Alliance Houston (the Petitioner). The petition requested that the EPA object to a Clean Air Act (CAA) title V operating permit issued by the Texas Commission on Environmental Quality (TCEQ) to Shell Chemical LP, for its Deer Park Chemical Plant located in Harris County, Texas. In addition, and as a part of the Order, the EPA Administrator found that cause exists to reopen the Shell Chemical Deer Park Chemical Plant permit pursuant to 40 CFR part 70.7.

This action delays the effective date of a final rule published in the Federal Register on December 9, 2024, amending Very High Frequency Omnidirectional Range (VOR) Federal Airways V-68, V-212, and V-222, and United States Area Navigation (RNAV) Route T-220; and revoking VOR Federal Airway V-558. The FAA is delaying the effective date to allow sufficient time for completing the update and flight inspection of a Standard Terminal Arrival Route (STAR) instrument procedure into George Bush Intercontinental/Houston Airport, TX, that failed the initial flight inspection and a STAR instrument procedure into San Antonio International Airport, TX, that also failed the initial flight inspection. The STARs are being amended in support of the planned decommissioning of the VOR portion of the Industry, TX (IDU), VOR/Tactical Air Navigation (VORTAC).

🌊Texas Deepwater Horizon Restoration Plan Open for Comments

The Deepwater Horizon (DWH) natural resource Trustees for the Texas Trustee Implementation Group (Texas TIG) have prepared the Draft Restoration Plan/Environmental Assessment #3: Wetlands, Coastal, and Nearshore Habitats (Draft RP/EA #3). The Draft RP/EA #3 proposes alternatives to help restore wetlands, coastal, and nearshore habitats impacted by the DWH oil spill. The Draft RP/EA #3 evaluates eight restoration alternatives under the Oil Pollution Act of 1990 (OPA), including criteria set forth in the OPA Natural Resource Damage Assessment (NRDA) regulations and the National Environmental Policy Act (NEPA) and its implementing regulations. A No Action Alternative is also evaluated pursuant to the NEPA. The total estimated cost to implement the Texas TIG's seven preferred alternatives is approximately $40 million. The Texas TIG invites the public to comment on the Draft RP/EA #3.

This proposed rule would implement a recommendation from the Texas Valley Citrus Committee (Committee) to increase the assessment rate established for the 2024-2025 and subsequent fiscal periods from $0.03 to $0.04 per 7/10-bushel carton or equivalent of oranges and grapefruit grown in Texas. The proposed assessment rate would remain in effect indefinitely unless modified, suspended, or terminated.
