⚡New Energy Efficiency Testing Rules for General Service Lamps

The U.S. Department of Energy ("DOE") is adopting clarifications to the test procedures for general service lamps ("GSLs") located in appendix W, appendix BB and appendix DD. Specifically, DOE is clarifying instructions that GSLs must not be tested as colored lamps and that lamps with additional components that do not affect light output must be turned off during testing. The clarifications also specify that non-integrated lamps be tested with a fluorescent lamp ballast, high intensity discharge ("HID") lamp ballast or external light-emitting diode ("LED") driver selected based on compatibility lists and availability; and provide specifications regarding the starting method, ballast factor, and number of lamps. This rulemaking is limited in scope and is providing clarifications to the current test procedures that are required for certification of compliance with existing applicable GSL energy conservation standards. Further, this rulemaking does not satisfy the Energy Policy and Conservation Act ("EPCA") requirement that, at least once every 7 years, DOE review the test procedures for GSLs.

🐟Proposed Rule for Clear Lake Hitch

We, the U.S. Fish and Wildlife Service (Service), propose to list the Clear Lake hitch (Lavinia exilicauda chi), a freshwater fish subspecies in the North American minnow family that is restricted to the Clear Lake watershed in Lake County, California, as a threatened species under the Endangered Species Act of 1973, as amended (Act). This determination also serves as our 12-month finding on a petition to list the Clear Lake hitch. After a review of the best available scientific and commercial information, we find that listing the Clear Lake hitch is warranted. Accordingly, we propose to list the Clear Lake hitch as a threatened species with protective regulations issued under section 4(d) of the Act ("4(d) rule"). If we finalize this rule as proposed, it would add the Clear Lake hitch to the List of Endangered and Threatened Wildlife and extend the Act's protections to this subspecies.

✈️Delay of FAA Airspace Rule Effective Date

This action delays the effective date of a final rule published in the Federal Register on December 9, 2024, amending Very High Frequency Omnidirectional Range (VOR) Federal Airways V-68, V-212, and V-222, and United States Area Navigation (RNAV) Route T-220; and revoking VOR Federal Airway V-558. The FAA is delaying the effective date to allow sufficient time for completing the update and flight inspection of a Standard Terminal Arrival Route (STAR) instrument procedure into George Bush Intercontinental/Houston Airport, TX, that failed the initial flight inspection and a STAR instrument procedure into San Antonio International Airport, TX, that also failed the initial flight inspection. The STARs are being amended in support of the planned decommissioning of the VOR portion of the Industry, TX (IDU), VOR/Tactical Air Navigation (VORTAC).

🏛️NIH Police Records Final Rule and Its Business Implications

The Department of Health and Human Services (HHS or Department) is issuing this final rule to make effective the exemptions that were previously proposed for a new Privacy Act system of records, "NIH Police Records," maintained by the National Institutes of Health (NIH), from certain requirements of the Act. The new system of records covers criminal and non-criminal law enforcement investigatory material maintained by the NIH Division of Police, a component of NIH which performs criminal law enforcement as its principal function. The exemptions are necessary and appropriate to protect the integrity of law enforcement proceedings and records compiled during the course of NIH Division of Police activities, prevent disclosure of investigative techniques, and protect the identity of confidential sources involved in those activities.

🌍Regulatory Notice on 8-Hour Air Quality Standards and Business Impact

The Environmental Protection Agency (EPA) has submitted an information collection request (ICR), Implementation of the 8-hour National Ambient Air Quality Standards for Ozone (EPA ICR Number 2347.05, OMB Control Number 2060-0695) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act. This is a proposed extension of the ICR, which is currently approved through January 31, 2025. Public comments were previously requested, via the Federal Register, on August 15. 2024 during a 60-day comment period. This notice allows for an additional 30 days for public comments.

⚖️MSPB's Proposal for Reasonable Accommodation Information Collection

The U.S. Merit Systems Protection Board (MSPB), as part of its continuing effort to reduce paperwork and respondent burden, intends to request approval of a new information collection from the Office of Management and Budget (OMB) under the Paperwork Reduction Act of 1995. MSPB is submitting this Information Collection Request (ICR), entitled Accommodation Request Form, OMB Control No. 3124-0NEW, for approval in accordance with Federal regulations, and is requesting public comments. This collection was developed as part of MSPB's effort to streamline the process for collecting information from employees and applicants to MSPB, as well as participants in MSPB functions (parties and/or participants in MSPB appeals, respondents to surveys, and all other individuals engaged in activity conducted by the MSPB), who seek a reasonable accommodation in order for MSPB to carry out its functions with respect to these individuals. The purpose of this notice is to allow 60 days for public comment preceding submission of the collection to OMB.

🌊New Regulations for Navy Activities and Marine Mammal Protections

NMFS, upon request from the U.S. Navy (Navy), issues these regulations pursuant to the Marine Mammal Protection Act (MMPA) to govern the taking of marine mammals incidental to the training and testing activities conducted in the Hawaii-Southern California Training and Testing (HSTT) Study Area between 2018 and 2025. In 2021, two separate U.S. Navy vessels struck unidentified large whales on two separate occasions, one whale in June 2021 and one whale in July 2021, in waters off Southern California. The takes by vessel strike of the two whales by the U.S. Navy were covered by the existing regulations and Letters of Authorization (LOAs), which authorize the U.S. Navy to take up to three large whales by serious injury or mortality by vessel strike between 2018 and 2025. The Navy reanalyzed the potential of vessel strike in the HSTT Study Area, including the recent strikes, and as a result, requested two additional takes of large whales by serious injury or mortality by vessel strike for the remainder of the current regulatory period. In May 2023, a U.S. Navy vessel struck a large whale in waters off Southern California. NMFS reanalyzed the potential for vessel strike based on new information, including the three strikes, and authorizes two additional takes of large whales by serious injury or mortality by vessel strike for the remainder of the current regulatory period (two takes in addition to the three takes authorized in the current regulations). The Navy's activities qualify as military readiness activities pursuant to the MMPA, as amended by the National Defense Authorization Act for Fiscal Year 2004 (2004 NDAA).

📜Notice of Inventory Completion and Repatriation Implications in Oklahoma

In accordance with the Native American Graves Protection and Repatriation Act (NAGPRA), the Sam Noble Oklahoma Museum of Natural History (SNOMNH) has completed an inventory of human remains and associated funerary objects and has determined that there is a cultural affiliation between the human remains and associated funerary objects and Indian Tribes or Native Hawaiian organizations in this notice.
