🚚Proposed Rule on Portable Conveyor Brake Requirements

FMCSA proposes to add an exception for portable conveyors used in aggregate industry operations, and manufactured before 2010, from the requirements that each commercial motor vehicle (CMV) be equipped with brakes acting on all wheels, provided certain conditions are satisfied. This proposal is in response to a petition for rulemaking from the Michigan Aggregates Association (MAA). The proposed change would provide relief from a regulatory requirement for certain portable conveyors without impacting safety.

✈️Airworthiness Directive Proposed for Boeing 737-600 Airplanes

The FAA proposes to supersede Airworthiness Directive (AD) 2013-08-08, which applies to certain The Boeing Company Model 737-600 series airplanes. AD 2013-08-08 requires repetitive inspections for cracking of the fuselage skin at certain locations at chem-mill steps, and repair if necessary. AD 2013-08-08 also provides optional terminating action for the repetitive inspections. Since the FAA issued AD 2013-08-08, Boeing has reported that the compliance times are not adequate because new fleet data indicates that crack growth is faster and more distributed between tear straps, resulting in longer cracks than originally observed in the test data that prompted AD 2013-08-08. This proposed AD would continue to require the actions in AD 2013-08- 08, at reduced initial compliance times and repetitive intervals for the inspections, and mandate post-modification inspections if the optional modification is accomplished. The FAA is proposing this AD to address the unsafe condition on these products.

🚦Proposed Regulation on Railroad Grade Crossings for CMVs

FMCSA proposes to amend the regulations related to driving a commercial motor vehicle (CMV) at railroad grade crossings. Currently, drivers of certain CMVs (e.g., buses transporting passengers and CMVs transporting certain hazardous materials) are required to stop before crossing a railroad track unless an exception applies, such as when the crossing is controlled by a functioning highway traffic signal transmitting a green indication. The Agency proposes to add a similar exception for a railroad grade crossing equipped with an active warning device that is not in an activated state (e.g., flashing lights or crossing gates down, indicating the arrival of a train).

The Federal Maritime Commission ("Commission") intends to revoke certain exemptions that had been granted to some controlled carriers, allowing for their rates, charges, classifications, rules or regulations to become effective with less than thirty (30) days' notice. This revocation would apply to exemptions that were granted to entities that have since been removed from the Commission's list of controlled carriers. Exemptions that have been granted to controlled carriers that remain on this list would continue to be valid but may be reviewed in the future. This draft supplement to the 2020 final supplemental environmental impact statement (2020 final SEIS) concerns the NRC staff's review of the environmental impacts of the proposed SLR of Renewed Facility Operating License Nos. DPR-44 and DPR-56 for Peach Bottom Units 2 and 3, respectively, for an additional 20 years. Peach Bottom is located primarily in Peach Bottom Township, York County, Pennsylvania, near Delta, Pennsylvania. Possible alternatives to the proposed action of SLR include the no-action alternative and reasonable replacement power alternatives. A new notice of opportunity to request a hearing and petition for leave to intervene--limited to contentions based on new information in the draft supplement--is also being issued.
