🦎Incidental Take Permit Application for Sand Skink in Orange County, FL

We, the Fish and Wildlife Service (Service), announce receipt of an application from Waste Management (Pine Ridge Recycling & Disposal Facility) (applicant) for an incidental take permit (ITP) under the Endangered Species Act (ESA). The applicant requests the ITP to take the federally listed sand skink incidental to the construction of an expansion of the existing Pine Ridge Recycling & Disposal Facility in Orange County, Florida. We request public comment on the applicant's proposed habitat conservation plan (HCP) and on the Service's preliminary determination that the proposed permitting action may be eligible for a categorical exclusion pursuant to the National Environmental Policy Act (NEPA), the Department of Interior's (DOI) NEPA regulations, and the DOI Departmental Manual (DM). To make this preliminary determination, we prepared a draft screening form and NEPA statement for HCPs, which is available for public review. We invite comment from the public and local, State, Tribal, and Federal agencies.

🔥EPA Allows Temporary Incinerator Use During Disaster Recovery

The U.S. Environmental Protection Agency (EPA) is taking interim final action to provide for the temporary use of incineration units subject to commercial and industrial solid waste incinerator (CISWI) regulations during disaster recovery. Currently, only other solid waste incinerators (OSWI) are authorized to combust debris from a disaster or emergency on a temporary basis without having to comply with applicable Clean Air Act (CAA) section 129 requirements. We are also authorizing such temporary use for incinerators (including air curtain incinerators (ACI)) subject to CISWI regulations by adding temporary-use provisions that essentially mirror those in the OSWI regulations to existing Federal CISWI rule subparts. The EPA is requesting comments on all aspects of this interim final rule and will consider all comments received after the conclusion of the comment period.

⚠️EPA Approves Replacement Waste Panels at WIPP

The U.S. Environmental Protection Agency (EPA, or the Agency) has approved the U.S. Department of Energy's (DOE, or the Department) planned change request to dispose of defense transuranic (TRU) waste in replacement panels 11 and 12 in the Waste Isolation Pilot Plant (WIPP). This decision is based on a thorough review of information submitted by DOE, independent technical analyses, and public comments. EPA found that DOE demonstrated that the use of two replacement waste panels to replace lost waste disposal volume in panels 1, 7, and 9, would provide a reasonable expectation of the WIPP remaining in compliance with the 10,000-year release limits set by the "Environmental Standards for the Management and Disposal of Spent Nuclear Fuel, High-Level and Transuranic Radioactive Wastes" at 40 CFR part 191.

♻️Implications of EPA's New Hazardous Waste Management Rule

The Environmental Protection Agency (EPA or the Agency) is taking direct final action to establish an additional option for owners or operators of active coal combustion residuals (CCR) facilities or inactive CCR facilities with a legacy CCR surface impoundment to comply with the facility evaluation report (FER) Part 1 requirements and to extend compliance deadlines for the remaining CCRMU provisions published in the Federal Register on May 8, 2024. The May 8, 2024 rule (Legacy Final Rule) established regulatory requirements for legacy CCR surface impoundments and CCR management units (CCRMU) under the Resource Conservation and Recovery Act (RCRA).

♻️Oklahoma Emissions Control Plan Approval

Pursuant to the Federal Clean Air Act (CAA or the Act), the Environmental Protection Agency (EPA) is approving the CAA section 111(d) state plan submitted by the State of Oklahoma for sources subject to the Municipal Solid Waste (MSW) Landfills Emission Guidelines (EG). The Oklahoma MSW landfills plan was submitted to fulfill the state's obligations under CAA section 111(d) to implement and enforce the requirements under the MSW Landfills EG. The EPA is approving the state plan and amending the agency regulations in accordance with the requirements of the CAA.

♻️Final OSWI Emission Standards and Compliance Guidelines by EPA

This action finalizes the periodic review by the U.S. Environmental Protection Agency (EPA) of the emissions standards and other requirements for Other Solid Waste Incineration (OSWI) units in the OSWI New Source Performance Standards (NSPS) and Emission Guidelines (EG). The EPA is finalizing applicability-related and definitional changes; changes to OSWI subcategories and the standards for the new subcategories; changes to the startup, shutdown, and malfunction (SSM) provisions; and changes to testing, monitoring, recordkeeping, and reporting requirements. We are also making other miscellaneous technical and editorial changes to the regulatory text.

🌍New York Air Plan Approval for Fuel Composition and Use Regulations

The Environmental Protection Agency (EPA) is approving revisions to the New York State Implementation Plan (SIP) concerning the control and reduction of sulfur and particulate matter emissions from facilities in New York State. The SIP revisions consist of amendments to regulations outlined within New York's Codes, Rules and Regulations (NYCRR) for sulfur in fuel limits and the use of waste oil as fuel. The intended effect of the revisions is to approve control strategies, required by the Clean Air Act (CAA), which will result in emission reductions that will help attain and maintain National Ambient Air Quality Standards (NAAQS) for sulfur dioxide and fine particulate matter emissions throughout New York State. Additionally, the revisions will establish applicability criteria, composition limits, and permitting requirements for waste oils; provide monitoring, recordkeeping, and reporting requirements for facilities that are determined eligible to burn waste oil; update conditions required for the firing of waste oils in space heaters at automotive maintenance/service facilities to align with both Federal and New York State hazardous waste regulations; and simplify and streamline implementation of the regulation through the correction of typographical errors and elimination of obsolete regulatory references within provisions. This action is being taken in accordance with the requirements of the CAA.

♻️EPA Closes Public Comment Period on WIPP Replacement Panels

On July 16, 2024, the Environmental Protection Agency (EPA or the Agency) announced for public comment the availability of a Planned Change Request (PCR) submitted by the U.S. Department of Energy (DOE) to modify the Waste Isolation Pilot Plant (WIPP). The proposed change will involve adding two additional waste panels west of the current repository to replace lost disposal capacity resulting from the 2014 radiological incident and ground control issues throughout WIPP's operational history. A 60-day comment period was provided for the PCR that expired on September 16, 2024. After requests from stakeholders for an extension, the EPA reopened the public comment period indefinitely on October 22, 2024. The Agency is now announcing the closure of the public comment period.
