We, the Fish and Wildlife Service (Service), announce receipt of an application from Waste Management (Pine Ridge Recycling & Disposal Facility) (applicant) for an incidental take permit (ITP) under the Endangered Species Act (ESA). The applicant requests the ITP to take the federally listed sand skink incidental to the construction of an expansion of the existing Pine Ridge Recycling & Disposal Facility in Orange County, Florida. We request public comment on the applicant's proposed habitat conservation plan (HCP) and on the Service's preliminary determination that the proposed permitting action may be eligible for a categorical exclusion pursuant to the National Environmental Policy Act (NEPA), the Department of Interior's (DOI) NEPA regulations, and the DOI Departmental Manual (DM). To make this preliminary determination, we prepared a draft screening form and NEPA statement for HCPs, which is available for public review. We invite comment from the public and local, State, Tribal, and Federal agencies.

The U.S. Environmental Protection Agency (EPA) is taking interim final action to provide for the temporary use of incineration units subject to commercial and industrial solid waste incinerator (CISWI) regulations during disaster recovery. Currently, only other solid waste incinerators (OSWI) are authorized to combust debris from a disaster or emergency on a temporary basis without having to comply with applicable Clean Air Act (CAA) section 129 requirements. We are also authorizing such temporary use for incinerators (including air curtain incinerators (ACI)) subject to CISWI regulations by adding temporary-use provisions that essentially mirror those in the OSWI regulations to existing Federal CISWI rule subparts. The EPA is requesting comments on all aspects of this interim final rule and will consider all comments received after the conclusion of the comment period.

The U.S. Environmental Protection Agency (EPA, or the Agency) has approved the U.S. Department of Energy's (DOE, or the Department) planned change request to dispose of defense transuranic (TRU) waste in replacement panels 11 and 12 in the Waste Isolation Pilot Plant (WIPP). This decision is based on a thorough review of information submitted by DOE, independent technical analyses, and public comments. EPA found that DOE demonstrated that the use of two replacement waste panels to replace lost waste disposal volume in panels 1, 7, and 9, would provide a reasonable expectation of the WIPP remaining in compliance with the 10,000-year release limits set by the "Environmental Standards for the Management and Disposal of Spent Nuclear Fuel, High-Level and Transuranic Radioactive Wastes" at 40 CFR part 191.

Pursuant to the Federal Clean Air Act (CAA or the Act), the Environmental Protection Agency (EPA) is approving the CAA section 111(d) state plan submitted by the State of Oklahoma for sources subject to the Municipal Solid Waste (MSW) Landfills Emission Guidelines (EG). The Oklahoma MSW landfills plan was submitted to fulfill the state's obligations under CAA section 111(d) to implement and enforce the requirements under the MSW Landfills EG. The EPA is approving the state plan and amending the agency regulations in accordance with the requirements of the CAA.
