⚖️USMCA Correcting Amendments

On January 17, 2025, U.S. Customs and Border Protection (CBP) published an interim final rule in the Federal Register amending the CBP regulations to add implementing regulations for the preferential tariff treatment and related customs provisions of the Agreement Between the United States of America, the United Mexican States, and Canada (USMCA) related to general definitions, drawback and duty- deferral programs, textile and apparel goods, and automotive goods, among others. Errant amendatory instructions resulted in the inadvertent omission of two conforming amendments and the removal of two paragraphs that were unrelated to the USMCA amendments. This action corrects those errors.

On July 21, 2025 the Binational Panel issued its Decision in the matter of Certain Softwood Lumber Products from Canada: Final Results of Antidumping Duty Administrative Review, 2017-2018 (Secretariat File Number: USA-CDA-2020-10.12-02). A Request for Panel Review was filed in the matter of Large Diameter Welded Pipe from Canada: Final Determination of the Five Year- Review of the Antidumping Order with the U.S. Section of the USMCA Secretariat on May 30, 2025. 🚗Procedures for USMCA Automobile Importers on Tariff Treatment

In the Proclamation of March 26, 2025, "Adjusting Imports of Automobiles and Automobile Parts Into the United States," the President imposed additional tariffs on imports of specified automobiles and automobile parts to eliminate the threat to national security posed by such imports. That Proclamation also provided that for automobiles that qualify for preferential tariff treatment under the United States-Mexico-Canada Agreement (USMCA), importers of such automobiles may submit documentation to the Secretary of Commerce (Secretary) identifying the amount of U.S. content in each model imported into the United States. This notice establishes procedures for submission and review of such documentation by the Department of Commerce (Department).

This document also amends the regulations to implement the temporary admission of goods, to delineate recordkeeping and protest requirements, to clarify the fee provisions, and to make conforming amendments, including technical corrections to other laws as required by statute.
