📄Updated Legal Framework for Patent Electronic System by USPTO

The United States Patent and Trademark Office (USPTO) published on its website an updated legal framework for its Patent Electronic System. The updated legal framework defines the USPTO patent electronic filing system requirements, and provides guidance on the relevant statutes, regulations, and policies that support the USPTO's Patent Electronic System. The Patent Electronic System currently comprises Patent Center. Patent Center includes both the USPTO patent electronic filing system, which is a web-based patent application and document submission system, and the USPTO's web-based means for electronically viewing the status of, and documents filed in or associated with, patent applications and proceedings. The updated legal framework also discusses the two-step authentication method now in place for accessing the Patent Electronic System. The updated legal framework serves as a reference for applicants, patentees, parties in reexamination proceedings, attorneys, and agents.

📄Changes to TTAB Response Times Affect Businesses and Trademark Filings

The Trademark Trial and Appeal Board (TTAB) is revising its practice in setting the initial period of time to answer or submit an acceptable response to a complaint in a TTAB trial proceeding as a result of a re-calculation of time to respond to a provisional refusal pursuant to the Madrid Protocol. Currently, TTAB's established time period for response is forty (40) days from the notice of institution of the TTAB proceeding ("institution order"). The period to file a response is now revised to sixty (60) days from the date of the institution order. This amendment has no impact or effect on the current TTAB Rules of Procedure.

📈Increase in Annual Limit for Prioritized Patent Examination Requests

The Leahy-Smith America Invents Act (AIA) includes provisions for prioritized examination of patent applications. Those provisions have been implemented by the United States Patent and Trademark Office (USPTO) in previous rulemakings. The AIA provides that the USPTO may not accept more than 10,000 requests for prioritization in any fiscal year (October 1 to September 30) until regulations setting another limit are prescribed. In 2019 and 2021, the USPTO published interim rules that expanded the limit on the number of requests to 12,000 and 15,000, respectively. The current final rule further expands the availability of prioritized examination by increasing the limit on the number of prioritized examination requests that may be accepted in a fiscal year to 20,000.

This final rule modifies U.S. trademark regulations addressing the replacement of a national registration or registrations by an international registration to allow for submission of partial replacement requests, in alignment with the Madrid Protocol, and to require a listing of the goods and/or services for which replacement is requested.
