⚠️Proposed NPDES General Permit for Bulk Fuel Facilities in Guam
The Environmental Protection Agency (EPA) Region 9 is proposing to reissue a NPDES general permit authorizing discharges of treated effluent from bulk fuel storage facilities located in Guam (Permit No. GUG000001). EPA proposes to reissue the permit upon completion of the notice and comment period and after consideration of all comments received. Upon issuance, the permit will be valid for five years. Use of a NPDES general permit allows EPA and dischargers to allocate resources in a more efficient manner while ensuring consistent permit conditions for comparable facilities. EPA is also taking comments on the frequency, duration, and volume of water discharges from each bulk fuel facility for the years including 2019 to 2024.

The Environmental Protection Agency (EPA) is finalizing, largely as proposed, a narrow modification to its 2022 Construction General Permit (CGP) to expand the list of areas eligible for coverage to include construction projects in all Lands of Exclusive Federal Jurisdiction. This modification is necessary because the EPA is the permitting authority in Lands of Exclusive Federal Jurisdiction, and when the CGP was issued on February 17, 2022, the permit did not specifically provide eligibility for these areas as a class. The modification also clarifies the CGP requirements that apply to projects that discharge to receiving waters within Lands of Exclusive Federal Jurisdiction in response to the Supreme Court's recent decision in City and County of San Francisco v. The Environmental Protection Agency (EPA) Region 6 is providing notice of a Revised Designation Decision that storm water discharges from the Los Alamos Urban Area (as defined by the latest decennial Census) and Los Alamos National Laboratory (LANL) property in Los Alamos County and Santa Fe County, New Mexico are contributing to violations of New Mexico Water Quality Standards (WQS) and require National Pollutant Discharge Elimination System (NPDES) permit coverage under the Clean Water Act (CWA). This action is in response to a June 30, 2014, petition filed with EPA by Amigos Bravos entitled "A Petition by Amigos Bravos for a Determination that Storm Water Discharges in Los Alamos County Contribute to Water Quality Standards Violations and Require a Clean Water Act Permit," and revises the Agency's prior December 16, 2019, designation decision, which was remanded to EPA for reconsideration by the United States Court of Appeals for the Tenth Circuit.
