🌬️Proposed Amendments to Oklahoma NSPS Delegation by EPA

The Environmental Protection Agency (EPA) is proposing to update federal regulations to reflect Oklahoma's current New Source Performance Standards (NSPS) delegation status and the mailing address for the Oklahoma Department of Environmental Quality (ODEQ). The ODEQ has submitted updated regulations for the delegation of EPA authority for implementation and enforcement of certain NSPS. The updated State regulations incorporate by reference certain NSPS promulgated by EPA, as they existed through June 30, 2023. The delegation of authority for implementation and enforcement applies to sources subject to the delegated NSPS, including those located in certain areas of Indian country as discussed herein.

🚧Adoption of Categorical Exclusion for Sanitation Facility Construction

The Department of the Interior (Department) is notifying the public and documenting the adoption of the Indian Health Service (IHS) categorical exclusion (CE) for actions associated with construction of sanitation facilities to serve Indian homes and communities, under section 109 of the National Environmental Policy Act (NEPA). The CE is adopted for use by the Bureau of Indian Affairs (BIA). In accordance with section 109, this notice identifies the types of actions to which BIA will apply the CE, the considerations that BIA will use in determining the applicability of the CE, and the consultation between the agencies on the use of the CE, including application of extraordinary circumstances.

💧Proposed NPDES Permit for Wastewater Discharges in EP Region 8

The EPA Region 8 is requesting comments on the draft 2025 National Pollutant Discharge Elimination System (NPDES) drinking water general permit (DWGP) for wastewater discharges associated with drinking water treatment plants. The DWGP will authorize wastewater discharges from drinking water facilities located in Indian country in the EPA Region 8 in accordance with the terms and conditions described therein. This is the first reissuance of the DWGP. EPA proposes to issue the permit for five (5) years and is seeking comment on the draft permit.
