🌱Guidelines for Climate-Smart Ag Practices in Biofuel Production

This interim rule with request for comment establishes technical guidelines for quantifying, reporting, and verifying the greenhouse gas (GHG) emissions associated with agricultural production of biofuel feedstock commodity crops grown in the United States in the context of environmental service markets. Specifically, the rule establishes guidelines for the reporting and verification of practices and technologies used in the production of certain commodity crops that result in lower greenhouse gas emissions or increases in carbon storage. These practices are referred to in the context of this rule as climate-smart agriculture (CSA) practices. The guidelines established through this rule articulate an approach for farm producers to quantify the GHG emissions associated with crops produced using one or more CSA practices. The guidelines also articulate a framework for how information regarding GHG emissions, resulting from the production of biofuel feedstock commodity crops, could be reported and tracked throughout the supply chain.

The Bureau of Land Management (BLM) intends to prepare an Environmental Impact Statement (EIS) for approximately 3,224 oil and gas leases sold in Colorado, Montana, New Mexico, North Dakota, South Dakota, Utah, and Wyoming and issued pursuant to 74 individual lease sale decisions. The EIS will provide a comprehensive analysis of the potential environmental impacts from these leases, which have been remanded to BLM for further review, including the impacts of greenhouse gas emissions (to include the social cost of carbon) and other common impacts.

🌍EPA Seeks Comments on U.S. Greenhouse Gas Emissions Report

The Draft Inventory of U.S. Greenhouse Gas Emissions and Sinks: 1990-2023 report is available for public review. Sectoral chapters within the report and cross-cutting summary and trends chapters will be posted to the identified docket on a rolling basis between January 15 and February 13, 2025. The Environmental Protection Agency (EPA) requests recommendations for improving the overall quality of the inventory report to be finalized in April 2025, as well as subsequent inventory reports.

🌍EPA Finalizes New Greenhouse Gas Emission Standards for Power Plants

The U.S. Environmental Protection Agency (EPA) is providing notice that it has responded to two petitions for reconsideration of the final action titled, "New Source Performance Standards for Greenhouse Gas Emissions From New, Modified, and Reconstructed Fossil Fuel-Fired Electric Generating Units; Emission Guidelines for Greenhouse Gas Emissions From Existing Fossil Fuel-Fired Electric Generating Units; and Repeal of the Affordable Clean Energy Rule", published in the Federal Register on May 9, 2024. The Administrator has denied or partially denied the requests for reconsideration in separate letters to the petitioners. The basis for the EPA's action is set out fully in the accompanying decision document, available in the rulemaking docket. At this time, the EPA is not addressing other grounds for reconsideration that have been raised by these or other petitioners.

❌Proposed Rule Withdrawal on Greenhouse Gas Emissions Impact

DoD, GSA, and NASA are withdrawing the proposed rule to amend the Federal Acquisition Regulation (FAR) titled: Disclosure of Greenhouse Gas Emissions and Climate-Related Financial Risk. Executive Order 14030, directed the Federal Acquisition Regulatory Council to consider amending the Federal Acquisition Regulation (FAR) require major Federal suppliers to publicly disclose greenhouse gas emissions and climate-related financial risk and to set science-based reduction targets. A proposed rule was published on November 14, 2022. The agencies lack sufficient time during the Biden-Harris Administration to finalize the proposal. In addition, the agencies' analysis of public comments indicates an evolving practices and standards in industry, and an evolving domestic and international regulatory landscape. Accordingly, this proposed rule is withdrawn, and the FAR case is closed.
