🌍EPA Notice on Risk Management Program Requirements for Businesses

The Environmental Protection Agency (EPA) has submitted an information collection request (ICR), Risk Management Program Requirements and Petitions to Modify the List of Regulated Substances the Clean Air Act (EPA ICR Number 1656.19, OMB Control Number 2050- 0144) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act (PRA). This is a proposed extension of the ICR, which is currently approved through September 30, 2025. Public comments were previously requested via the Federal Register on April 17, 2025 during a 60-day comment period. This notice allows for an additional 30 days for public comments.

🌫️Proposed Expansion of Northern Wasatch Front Ozone Nonattainment Area

The Environmental Protection Agency (EPA) is proposing to approve a request to expand the boundary for the Northern Wasatch Front (NWF) 2015 8-hour ozone national ambient air quality standard (NAAQS) nonattainment area (NAA). The request was submitted by the State of Utah on February 27, 2023. The newly expanded portion of the NWF NAA will have the same classification as the original NWF NAA under the 2015 ozone NAAQS and all applicable Clean Air Act (CAA) requirements will become applicable to the newly designated portion upon the effective date of the final action. The EPA is taking this action pursuant to the CAA.

🌬️Proposed Approval of Wyoming Air Quality Standards by EPA

The Environmental Protection Agency (EPA) is proposing to approve revisions to the Wyoming State Implementation Plan (SIP) submitted by the Wyoming Department of Environmental Quality (WDEQ) on December 16, 2024. WDEQ requested EPA approve the revisions for Chapters 2, 3, 4, 8, and 14 in the Wyoming Air Quality Standards and Regulations (WAQSR) The revised rules include non-substantive updates to rule language that ensure consistent grammar, formatting, and written clarity as well as updated references to the Code of Federal Regulations. These revisions do not change the intent or scope of each rule. The EPA is proposing approval of these SIP revisions because we have determined that they are in accordance with the requirements for SIP provisions under the Clean Air Act (CAA or the Act). The proposed approval of WAQSR Chapter 2, section 4 of the December 16, 2024 submittal supersedes the revisions to this section contained in WDEQ's February 10, 2014 SIP submittal that the EPA had not previously acted on. In the "Rules and Regulations" section of this Federal Register, we are approving these SIP revisions as a direct final rule without a prior proposed rule. If we receive no adverse comment, we will not take further action on this proposed rule.

🌬️EPA's Proposed Consent Decree for Kentucky Air Quality Compliance

In accordance with the Clean Air Act, as amended (CAA or the Act), notice is given of a proposed consent decree in Commonwealth of Kentucky v. U.S. Environmental Protection Agency, No. 3:24-CV-600-CHB (W.D. Ky.). On October 16, 2024, Plaintiffs the Commonwealth of Kentucky, Energy and Environment Cabinet (KY EEC); Rebecca Goodman, Secretary of the KY EEC; and the Louisville Metro Air Pollution Control District filed a complaint in the United States District Court for the Western District of Kentucky, Louisville Division. Plaintiffs allege that the Environmental Protection Agency (EPA or the Agency) failed to perform certain non-discretionary duties in accordance with the Act to timely approve or deny a request to redesignate the Kentucky portion of the Louisville, Kentucky-Indiana, 2015 8-hour ozone nonattainment area (the Area) to attainment for the 2015 8-hour ozone National Ambient Air Quality Standards (NAAQS or standards). The proposed consent decree would establish deadlines for EPA to approve or deny the request to redesignate.
